1. Nature of Platform

1.1 ArtizenLive operates as a booking facilitation and marketplace platform connecting clients with independent artists and performers across India.

1.2 ArtizenLive acts solely as an intermediary and shall NOT be considered a party to the performance contract between the client and the artist.

1.3 ArtizenLive does not provide performance services directly and does not employ artists.

1.4 All services are rendered solely by independent artists.

2. No Liability for Performance

2.1 ArtizenLive does not control or supervise the execution of performances.

2.2 ArtizenLive is NOT responsible for: performance quality, artist conduct, client dissatisfaction, equipment failure, on-site incidents, damages, or any contractual dispute between the client and artist.

2.3 Any performance agreement exists strictly between the Client and the Artist.

2.4 Under no circumstances shall ArtizenLive be considered liable for performance-related claims.

3. Scope of Platform Services

ArtizenLive provides:

• Artist discovery and booking facilitation.
• Advance payment coordination on behalf of the Artist.
• Platform service fees invoicing to the Artist.
• Documentation support, including booking confirmation and receipts.
• Promotional exposure for featured artists.

ArtizenLive does NOT assume responsibility for the execution of performances or event outcomes.

4. Booking & Payment Structure

4.1 Customers must pay an advance to confirm a booking. Advance payments are held on behalf of the Artist and do NOT constitute revenue of ArtizenLive.

4.2 ArtizenLive does not charge separate platform service fees to customers unless expressly agreed in writing.

4.3 The remaining balance is payable directly to the Artist unless otherwise agreed.

4.4 Platform service fees are charged solely by the Artist as per the Master Artist Agreement.

5. Platform Service Fees & GST

5.1 ArtizenLive charges platform service fees solely from the Artist based on the applicable slab.

5.2 GST at 18% applies only to ArtizenLive's platform service fees income.

5.3 ArtizenLive shall issue GST-compliant invoices to the Artist for its platform service fees.

5.4 Artists are responsible for issuing their own invoice to clients (if GST registered) and for their own tax compliance.

6. Cancellations & Refunds

Refund eligibility is governed by the separate Cancellation & Refund Policy. Refund percentages apply only to the advance amount payable to the Artist. In case of cancellation, any platform, service, or convenience fee charged by ArtizenLive is non-refundable. Any applicable refund will be calculated after deducting such fees, and the remaining amount will be refunded to the customer.

7. Client Obligations

Clients are expected to:

• Provide accurate event details at the time of booking.
• Obtain all required venue permissions and regulatory approvals.
• Ensure safety compliance at the event venue.
• Make timely payment of the balance directly to the Artist.
• Treat artists with professional respect and courtesy.

8. Artist Obligations

Artists are expected to:

• Deliver agreed performances professionally and on time.
• Provide technical requirements to the Client in advance.
• Always comply with the Master Artist Agreement.
• Carry valid identity documents to every event.
• Remain independent contractors — not employees of ArtizenLive.

9. Minor Artist Compliance

All performances involving minors must comply with applicable Indian child protection laws and require verified guardian consent. Payments for minor artists shall be made to verified guardian accounts only. ArtizenLive reserves the right to request compliance documentation.

10. Content & Media Usage

With prior consent, ArtizenLive may use event content (photos/videos) for promotional purposes, including social media, website, and marketing materials. Content removal requests will be addressed within 30 business days of a written request.

11. Data Protection

Personal data is handled in accordance with applicable Indian data protection laws, including the Digital Personal Data Protection Act, 2023. ArtizenLive does not sell user data. Full details can be found in our Privacy Policy.

12. Force Majeure

ArtizenLive is not liable for delays or failures due to events beyond reasonable control, including natural disasters, government restrictions, pandemics, venue closures, or technical disruptions.

13. Limitation of Liability

13.1 ArtizenLive's total liability, if any, shall not exceed the platform service fees earned for the specific booking in question.

13.2 ArtizenLive is not liable for indirect, incidental, consequential, or punitive damages.

13.3 ArtizenLive is not liable for loss of revenue, reputation, or opportunity arising from artist or client disputes.

14. Third-Party Vendors

ArtizenLive is not responsible for vendors, equipment providers, or third-party services not directly contracted through the platform.

15. Artist Substitution

If an artist is unable to perform, ArtizenLive will make reasonable efforts to arrange a replacement of equal or higher quality. Refunds, if applicable, shall follow the Cancellation & Refund Policy.

16. Anti-Bypass

Clients must not directly engage artists introduced through ArtizenLive, bypassing the platform, within 12 months of introduction. Violation may result in suspension from the platform and legal recovery of applicable fees.

17. Code of Conduct

All platform participants (clients, artists, and their representatives) must maintain professional, lawful, and respectful behaviour. Violations, including misconduct, fraud, harassment, or platform abuse, may result in immediate suspension or termination of their platform access.

18. Intellectual Property

All platform branding, content, materials, and digital assets remain the exclusive intellectual property of ArtizenLive. Unauthorised reproduction, distribution, or use is strictly prohibited.

19. Safety & Regulatory Compliance

Artists and clients are each responsible for complying with all applicable local laws, venue permissions, and public gathering regulations. ArtizenLive is not liable for penalties, fines, or legal action arising from non-compliance by either party.

20. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. All disputes shall be resolved through arbitration in Kolkata, West Bengal, under the Arbitration and Conciliation Act, 1996. Jurisdiction: Courts of Kolkata, West Bengal.

21. Amendments & Acceptance

ArtizenLive reserves the right to update these Terms at any time. Updated Terms will be posted on the platform with a revised effective date. Continued use of the platform after any update constitutes acceptance of the revised Terms.
